Homa Bay Member of Parliament, Peter Kaluma, has written a letter to the Speaker of the National Assembly, Moses Wetangula, proposing a bill that criminalizes homosexuality and unnatural sexual acts in Kenya.
Kaluma wants to increase the penalty for those convicted of engaging or promoting homosexuality acts to life imprisonment. In the letter, the MP claimed that the proposed law would strengthen the provisions of Article 45(2) of the Kenyan Constitution, which stipulates that “every adult has the right to marry a person of the opposite sex, based on the free consent of the parties.”
Kaluma argues that the proposed law is intended to protect the family and consolidate all existing laws relating to unnatural sexual acts. He has requested the Speaker’s office to provide the necessary facilities to aid in the consolidation of the Bill.
This proposal has elicited mixed reactions from various quarters. Proponents of the bill argue that homosexuality is a cultural and moral issue that goes against Kenya’s values and customs. Opponents, however, argue that such a law is a violation of human rights, including the right to privacy and freedom of association.
It’s worth noting that in 2019, the Kenyan High Court upheld laws criminalizing homosexual acts between consenting adults. However, some human rights activists and organizations have continued to push for the repeal of such laws. The proposed bill by Kaluma is likely to spark heated debates and discussions in the coming days.
