Philip White filed the lawsuit against T.W. Garner Food Co, claiming that its advertising deceived him after purchasing the $3 hot sauce at Ralph’s grocery store in 2021.
He alleges that the company was aware of the massive demand for “authentic” Texas hot sauce and “cheated its way to a market-leading position in the $3bn hot-sauce industry at the expense of law-abiding competitors and consumer.” Additionally, he noted that the bottle’s label included the lone star and a cowboy.
“White relied upon the language and images displayed on the front label of the product, and at the time of purchase understood the product to be a Texas product,” the complaint said. Additionally, he was surprised after learning that the hot sauce is manufactured in Winston-Salem, North Carolina.
