A Sabah High Court has set aside a 30-year jail term on an ophthalmologist for cultivating 12 cannabis plants at his Tawau house in 2020.




The judge says the prosecution had failed to prove that Azril Surash knew that the plant he was cultivating was forbidden under the law.


On Jan 27, a sessions court sentenced Surash to the maximum life imprisonment of 30 years and 6 strokes of the cane as the prosecution proved its case beyond reasonable doubt.


Surash subsequently filed an appeal.
