Justice Department special counsel Jack Smith has requested copies of the audio recording of Ted Cruz’ plot to decertify Biden’s win. (Read More Here)?

The request for evidence was made to Fox News producer Abby Grossberg – the recording’s source.  


That just sort of probably might be a pretty big f*cking deal. 


Cruz advocated for the creation of a congressionally appointed electoral commission ahead of the Jan. 6, 2021, attack on the U.S. Capitol to make a credible assessment of unsubstantiated claims of voter fraud in the 2020 election.


Behind the scenes, however, Cruz was cautioning Trump allies that they would need “specific evidence” of fraud if they wanted to prevail in court. In a new recording obtained Thursday by MSNBC’s Ari Melber, Cruz tells Fox Host Maria Bartiromo that they would need “actual facts” if their legal challenges to the election were to be taken seriously. 


Information reads: “Cancun TED CRUZ caught on tape talking to Maria Bartiromo of Fox outlining plot before January 6th.”


“It can’t just be, you know ‘somebody tweeted this,’” Cruz says, “It’s got to be demonstrable facts that can be laid out with evidence because that’s what a court of law is gonna look to — not just an allegation but actual facts.” 


Cruz went on to say that he was hopeful that “when Rudy [Giuliani] comes on the show tomorrow, he had some of those facts, and I hope the legal team continues to lay out the specific evidence, because that’s what it’s gonna take to prevail in court.” 


Cruz added that he was “hopeful” that Trump’s personal lawyer Rudy Giuliani, who led the legal push to overturn the 2020 presidential results, “comes on the show tomorrow and he has some of those facts,” and he added, “I hope the legal team continues to lay out the specific evidence because that’s what it’s going to take to prevail in court.”


The recording was taken by a former Fox News producer who is suing the network. Abby Grossberg, who worked as a producer for Bartiromo and Tucker Carlson, has accused the network of harassment and alleged it pressured her into giving misleading testimony as part of the $1.6 billion Dominion Voting Systems defamation lawsuit.


Recordings she made of off-air conversations between Fox hosts and their guests, as well as her testimony in the case, reportedly helped spur the network to reach its $787.5 million settlement deal with Dominion. Fox News has denied that account.


Grossberg said during the Nicolle Wallace show that she has about ninety total recordings from inside Fox News. An hour later, on the Ari Melber show, Grossberg’s attorney announced that Special Counsel Jack Smith has reached out in order to acquire some of those recordings. He didn’t specify which recordings.


It sounds like Smith’s interest isn’t necessarily in Tucker Carlson, but instead in other recorded conversations. One of them involved Ted Cruz and Fox host Maria Bartiromo discussing how to overthrow the 2020 election results before it even happened. Another recording involved Rudy Giuliani privately admitting to Fox News that he had no evidence the 2020 election was rigged.


Why would Jack Smith want these recordings? Giuliani is already clearly one of his criminal targets. Giuliani will likely try to use the reasonable doubt defense that he honestly thought the election was rigged, and that if he broke the law in trying to overturn the results, it was well intentioned. But a recording of him privately admitting that he had no evidence, at a time when he was breaking the law and publicly claiming he did have evidence, would destroy Giuliani’s defense.
